Terms of Service

By accessing and using Whisper Web ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Whisper Web regarding your use of the Service.

Whisper Web provides a browser-based AI speech recognition service. The local transcription mode is currently offered at no cost. The service:

• Transcribes audio files into text using OpenAI's Whisper AI model
• Processes all audio locally in your browser using WebAssembly and WebGPU
• Supports 100+ languages for transcription
• Allows you to download transcriptions in various formats (TXT, JSON, SRT, VTT)
• Operates entirely client-side without uploading your audio to servers

The pricing model for the Service may change over time. We will provide reasonable notice of any significant changes to pricing or service availability.

Permitted Use: You may use the Service for personal, educational, or commercial purposes, subject to these Terms.

Restrictions: You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated scripts or bots to access the Service excessively
• Circumvent any access restrictions or usage limits
• Upload content that infringes on intellectual property rights
• Upload malicious files (viruses, malware, etc.)
• Use the Service to transcribe content that is illegal, harmful, or violates third-party rights
• Attempt to overload or interfere with the Service's infrastructure

When using the Service, you are responsible for:

• Content Ownership: Ensuring you have the right to transcribe any audio files you upload
• Privacy Compliance: Complying with applicable privacy laws when transcribing recordings of others
• Browser Compatibility: Using a modern browser that supports WebAssembly and WebGPU
• File Size Limits: Respecting reasonable file size limits (suggested maximum: 100MB per file)
• Accuracy Verification: Reviewing transcriptions for accuracy, as AI-generated transcriptions may contain errors

Service Ownership: The Service, including its code, design, and branding, is owned by Whisper Web and protected by copyright and other intellectual property laws.

Your Content: You retain all rights to your audio files and transcriptions. We do not claim ownership of any content you process through the Service.

Open Source Components: The Service uses open-source components including:

• OpenAI's Whisper model (MIT License)
• Transformers.js (Apache-2.0 License)
• Other open-source libraries as documented in our repository

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim:

• Accuracy: We do not guarantee 100% transcription accuracy. AI-generated transcriptions may contain errors, especially with accents, background noise, or specialized terminology.
• Availability: We do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance or technical issues.
• Compatibility: We do not guarantee compatibility with all browsers or devices. The Service requires modern browser features (WebAssembly, WebGPU).
• Fitness for Purpose: We do not guarantee the Service is suitable for any particular purpose, including medical, legal, or safety-critical applications.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHISPER WEB SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from transcription errors or inaccuracies
• Damages caused by service interruptions or unavailability
• Any damages exceeding $100 USD in total

You acknowledge that the local transcription mode is currently provided at no cost and that this limitation of liability is reasonable given the nature of the Service.

Service Changes: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice.

Terms Changes: We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the modified Terms. The "Effective Date" at the top will be updated when changes are made.

We reserve the right to terminate or suspend your access to the Service at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the Service
• Exposes us to legal liability
• Otherwise is inappropriate or unlawful

You may discontinue use of the Service at any time by simply closing the browser tab.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
